estimates: Fees and estimates are minimum estimates only. While I make every effort to stay within estimates, you should be aware that your request for significant changes in direction may result in additional charges. Your approval will be required before extra charges are incurred.
changes: As the client, you are responsible for making additional payments for changes in the original assignment that you requested.
cancellation: If a project is cancelled, I will retain ownership of all artwork, whether preliminary or final. No refunds will be made for cancelled projects.
credit lines and portfolio usage: A copyright/credit line attributing design work to Joe Whyte, SEOTEAM.org or Webmastermydomain.com linked to my Web site will appear at the bottom of each page in your site. Copyright lines will also be included for photography or other artwork purchased from other creatives. Your Web site may be represented in and linked to from my online portfolio.
copyright license: License is granted for use of Web graphics only for use on your website that our team works on. I retain rights to my original Photoshop layers files, flash files and any artist property. My graphics may not be transferred to another site or to any other party, re-purposed, modified or used for other purposes without my written permission. Additional uses may require payment of mutually agreed-upon fees. I do not sign "Work Made for Hire" agreements which transfer all rights to the client. Any usage rights not exclusively transferred are reserved to Joe Whyte, Webmastermydomain.com and SEOteam.org. Any transfer of rights is conditional upon receipt of full payment.
transfer of rights: To buy out the rights to your design with the exception of my credit line on each page of your site then add 15% to the final cost of your project, less out-of-pocket expenses such as photo use fees. You will receive a CDrom with the Photoshop files for your site. Fonts will not be included because I cannot legally transfer them to you.
dispute resolution: Any dispute arising out a dispute concerning your Web design project must be submitted to Small Claims Court or the Civil Court in the county in which SEOTem.org is located at the time the claim is submitted. On any award of judgement to Joe Whyte, SEOTeam.org or webmastermydomain.com, you will pay all court costs, reasonable attorney's fees, and legal interest.
time for payment: Payment is due prior to beginning the project.. Reimbursement for expenses such as usage rights for stock photography is due upon receipt of invoice.
how to pay: Payments are accepted via paypal, cash or check.
default in payment: You will be responsible for all legal fees necessitated by default in payment and all rights of usage will be revoked.
acceptance of terms: Payment of your design fee will be evidence of acceptance of these terms.
